The so-called Rolex case concerns whether a Danish consumer who had purchased a replica Rolex watch from a Chinese webshop must recognise that the watch was lawfully intercepted by the customs authorities and must be surrendered to the State without compensation. The case was tried on Tuesday 4 September 2012 and then set down for judgment.
On 18 September 2012, the Supreme Court decided to resume preparation of the case and refer questions to the Court of Justice of the European Union.
On 25 February 2012, the Supreme Court made a reference order containing the Court's questions for the Court of Justice, and the case has been stayed pending the Court of Justice's reply to the questions referred.
